Terms and Conditions
In the following terms & conditions “the photographer” shall mean anyone shooting under the umbrella of Newborn Portraits. The client shall be the who booked the shoot and signed general shoot booking form.
These terms & conditions cannot be varied in any way by the client(s) unless such conditions
are expressly agreed by the photographer in writing.
Session:
Your session time will begin at the stated time. Should you be late for any reason, the time will be deducted from your session and end at the original time.
The photographer nor Newborn Portraits can be held responsible for non cooperation from adults, children or pets.
We take no responsibility for clothing choices, or personal appearance.
Property:
We take no responsibility for yourself, family or your personal property while on/in our studio. Your car is parked at the owners risk. If your children wish to play at the park, or garden, we take no responsibility for this and advise adult supervision at all times.
Any damages that occur on our property by your party must be paid for in full before any images will be released.
Adult supervision:
Children should be supervised at all times. Please do not leave the photographer alone with your newborn. Any issues at the session need to be raised at the time.
Cameras/ phones:
Please do not take photos during your session solely of the sets/children. You may take 'behind the scenes' photos, which include the studio and myself, but not photos that could be considered photos taken by the photographer.
Copyright:
The client has purchased high-resolution digital files from his/her photography session with the Photographer and will be given a print release. Copyright will remain the property of the photographer.
Client is hereby granted permission by the photographer to reproduce the images and make an unlimited number of prints, for personal use on friends and family may purchase prints or digital copies from the Photographer only.
This permission applies worldwide. Client agrees that he/she may not use any images for commercial or editorial purposes, or enter any images into competition without the express written permission of the Photographer. Photographer retains the copyright to all images.

The images that are being provided to you are licensed to you for any reasonable personal purposes, including but not limited to: printing, copying, emailing, and web publishing. Your license does not include use that results in financial gain, including but not limited to: advertising, stock photography, print sale profits, or resale of any nature.
Your purchase of the original files releases the Photographer from any liability due to loss or damage of the images, and also releases the Photographer from any obligation to maintain copies of any digital file, image, or photograph. You hereby grant to the Photographer the right to use and publish images and photographs taken at your photography session to further promote its service, including portfolio, web site, display, advertisement, and editorial use, unless you have expressed in writing you do not want the images used.
The Photographer may revoke this license at any time and for any reason. The Photographer retains all copyrights to the images and derivative works thereof. By using any of these images, you are agreeing to the above terms.
Display:
The client(s) hereby allow(s) the photographer to display any photograph covered by this contract
and to generally promote the business in advertising, brochures, magazine articles, websites,
sample albums etc.
Images:All image sizes are original, 10'x8' or 7'x5'. The Photographer will provide a pleasing colour balance but cannot
guarantee exact colour matching owing to anomalous reflectance caused by a combination of
certain dyes and materials especially man-made fibers. It is sometimes impossible to record on
film/sensor the exact colour as seen by the human eye.
Retouching:
The Photographer will retouch, digitally manipulate and finish according to his/her own discretion.
Any retouching, digital manipulation or finishing which is requested by the Client(s) may be
subject to an extra charge at the discretion of the Photographer. Extensive re-touching will be sent to a professional editor at your expense.
License, Coverage and Reproduction:
Photographs taken during the course of the shoot will be at the discretion of the photographer
although every effort will be made to comply with the clients requirements.
The photographer shall be granted artistic license in relation to the poses photographed
and the props/colours used.
The photographer's judgement regarding these matters shall be deemed correct.
The photographer shall endeavour to photograph all individuals as requested by the client(s) at
some point, but no responsibility will be taken by the photographer on the occasion of
leaving somebody out.
Due to a variety of lighting conditions and the limitations of digital sensors,
some colours may alter throughout a set of photographs.
Although all equipment is checked regularly and reasonable steps are taken to ensure backup
equipment is available, the photographer will not be responsible for photographs that are
not produced due to technical failure.
Prices:
All shoots and additional goods specified on the booking form are supplied
at the prices ruling on the date of booking.
Goods not specified on the booking form are supplied at the prices ruling at the time
of receipt of the order. Prices are subject to change.
Payments:
A non-refundable booking fee of £60.00 will confirm your booking, as well as full acceptance
of the terms and conditions.
The booking fee will NOT be deducted from the cost of the client's chosen collection when calculating
the final balance due.
Payment of the booking fee needs to be made in full before the shoot.
Additional goods ordered must be paid for in full at the time of ordering. Unless a payment plan is agreed, then products will be ordered after the full payment is received.
No refunds of any monies given towards products, session fees, or collections will be given if you cancel. Monies cannot be transfer to other products or shoots.
Titles to all goods remains with the photographer until paid for in full by the client(s).
Force Majeure:
If an occasion occurs due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding etc or in the very unlikely event of total photographic failure and a re-schedule isn't available by the photographer liability shall be limited to a full refund of any fees paid.
Cancellation:
If the client(s) should have to cancel a shoot the booking fee is non refundable. Should you wish to reschedule a new shoot the booking fee will be required again. This covers the loss of work for that day.
Viewing appointment:
After your gallery has been edited, you will be invited back for a in-person viewing appointment. Here you will be able to view your finished gallery and place your order.
Ordering is only available at this appointment and not afterwards. An online gallery will not be provided.
Payment plans are available upon request.
Complaints:
Any complaints should first be raised by the client to the Photographer at the viewing appointment. Should you wish, you may send an email straight after the appointment.
